Terms and Conditions

In accordance to the data which will be submitted by you regarding the real estate ownership transfer mentioned in your request, we inform you that your submitted request will be processed and a reference number will be issued to you stating the request VAT eligibility information whether it is subject to VAT or not. You (the “Seller”) acknowledge that the data provided in the request submitted may result in your automatic registration in the VAT system under your ID number as per KSA’s VAT laws and regulations. You further acknowledge that in order for the transfer of title to be processed, you hereby acknowledge, affirm and consent to the following:

1- that the information you provided is genuine and true and understand that by its submission you shall be held accountable for providing untrue or misleading information, and accept to pay any taxes that may arise from such act. You also accept to be held accountable with respect to the content of all information and documents attached to your request which been submitted through this electronic system. You further affirm to notify GAZT about any alteration or amendment made to any information or document concerning your request which directly or indirectly pertains to the VAT laws and regulations

2- in the course of title transfer, if the Property’s title deed inures to more than one person, the seller making the submission affirms that they are authorized to be designated as the primary Aeller, and that all information on the title deed are true and genuine.

3- that in the event you specify in your submissions that the concerned Property is VAT exempt, you have not deducted or requested a refund of any input VAT incurred in relation to the Property . You further affirm that, upon GAZT’s request. you shall provide it with all documentation justifying the exemption.

4- That the automatic generation of an invoices in you name as the primary Seller for an amount equal to the VAT due on the transfer of title of the Property if it is determined that VAT is due You understand that early settlement of the VAT amount (if any) is optional and that by making such payment you will have in early compliance with your VAT obligations related to the transfer of the Property. GAZT shall deposit in a personal account in the name of the Seller/Sellers as portion of such paid amount proportionate to each seller’s share in the ownership of the Property, with the default proportions being based on a presumption of equal ownership in case no evidence is submitted to the contrary. Upon execution of the transfer of title at the competent authority (MOJ), the deposited amounts will be used to settle the value of VAT due on the transfer of title of the Property based upon the tax return/returns filed by the seller/sellers.

5- that you will issue VAT invoice(s) in case the Property is subject-to-VAT and the Seller is a registered taxpayer or will become a registered taxpayer as a result of the transaction contemplated in the application made through this system. Invoices must be issued according to the actual data provided to the MOJ, which shall contain the Property’s value , and all other requested information as per article (53) of VAT Implementing Regulations within (15) days of the month following the month during which which the ownership transfer was effectuated.

6- that you consent and accordingly authorize GAZT to prepare VAT declarations on your behalf for the taxable period during which a taxable transfer of real property is made taxable through this system and effectuated by the MOJ. You acknowledge that you may amend declaration(s) prepared on your behalf through the GAZT portal. You further certify that before the declaration submission due date as per the Implementing Regulations, you shall declare any other subject-to-VAT supplies/sales you made or will make -whether or not related to the Property- during the period in which the Property is transferred. In the event you fail to amend/submit the declarations filled on your behalf, the declaration shall be submitted on your behalf on the last day of the end of the declaration submission period pursuant to the Implementing Regulations.

Note: with respect to kinship- mentioned in the –nature of property- section of this application, that first degree kinship means relatives to the first degree (i.e. father, mother, grandfathers and grandmothers), and relations to the second degree means children and grandchildren
